Terms of Contract, please read:

1. Lessee, in consideration of being permitted to rent bicycle(s), kayaks and other equipment from the Lessor, do for myself, my heirs, executors, administrators, and assigns, hereby release and forever discharge Island Cycles Inc. and/or owner from any and every claim, in law or in equity arising from or by reason of any accident which may occur as a result of my participation with or use of the above referenced equipment, whether by negligence or not.

2. Lessee further releases Island Cycles from any claim whatsoever for any resulting first aid, treatment or service rendered to me during my use of the above stated equipment.

3. Fees will be charged for any equipment returned late – no exceptions!!

4. No refunds will be given on rentals.

5. Bicycles are not to be ridden in the sand. Do not drag kayaks!!! Rince all equipment of salt water before return.

6. Lessee is financially responsible for any damage and/or loss to bicycle, kayak and/or equipment during rental period at a cost a determined by lessor.

7. Items dropped off by lessee without clerical check-in are still the responsibility of the lessee.

8. Neither the lessor nor the owner of the bicycle, kayak and/or equipment shall be liable for the loss, damage or expense resulting from the acts or omissions of the Lessee or any other person during the rental period, including but not limited to personal injuries, death and/or property damage to the Lessee or any other person. The Lessee agrees to indemnify and save harmless the Lessor and/or owner from any loss, damage or expense including attorney’s fees incurred by the Lessor and/or owner in connection herewith.

I have read the above and agree to all of the terms contained herein. I know that my deposit will be forfeited for any violation of the terms of this contract.

Scooter Rental Contract

Terms of Contract, please read:

1. The Lessee shall be liable for any damage to the scooter occurring during the rental period, and/or the loss of the scooter due to theft or otherwise during such period. The Lessee agrees to pay the following amounts or others as determined by Lessor:

Broken mirror…………$50 Broken fender…………..$75 Labor - varies Broken tail/turn ……… $50 Bent fork…………$500 Broken brake lever…….$50 Lost scooter……………$2000

Failure to report damages or attempts to cover them up will be considered fraud and vandalism, and reported to the police with charges pressed against Lessee.

2. Late Fees will be charged for scooters after time listed on contract – no exceptions!!

3. No refunds will be given on rentals.

4. Scooters are not to be ridden in the sand.

5. If you get a flat tire, you must get it plugged and report problem to lessor.

6. Pick-up of scooter for any reason will result in additional charges to lessee.

7. Racing, wheelies or horseplay on the scooter(s) will result in termination or rental without refund and forfeit of deposit taken for scooter.

8. The lessee agrees that he/she will check the scooter to ensure that it is in working condition, and covenants that he/she is knowledgeable in the operation of same and has been given proper instruction on the operation of the scooter.

9. The lessee agrees to obey all North Carolina motor vehicle laws and ordinances, including but not limited to:

a. All scooter operators and riders will wear a helmet while operating the vehicle.

b. No riding on dirt roads, beached or sand with said scooter.

c. Only the above named rider(s) shall drive the scooter(s).

d. Eye protection must be worn at all times.

e. Pregnant women are not advised to ride scooters.

10. Neither the lessor nor the owner of the scooter shall be liable for the loss, damage or expense resulting from the acts or omissions of the Lessee or any other person operating the scooter during the rental period, including but not limited to personal injuries, death and/or property damage to the Lessee or any other person. The Lessee agrees to indemnify and save harmless the Lessor and/or owner from any loss, damage or expense including attorney’s fees incurred by the Lessor and/or owner in connection herewith.

11. Lessee has reviewed the scooter condition with lessor.

12. Fuel must be filled to level as when rented.

I have read the above and agree to all of the terms contained herein. I know that my deposit will be forfeited and I will be financially liable for any violation of the terms of this contract, and agree that I have received thorough instruction in the operation of the rented scooter(s).
